These Terms of Use (“Terms”) govern your access to and use of the CrewCard mobile application, CrewCard web platform, and related services (collectively, the “Service”). The Service is operated by CrewCard USA LLC (“CrewCard”, “we”, “our”, or “us”).
By downloading, accessing, or using the Service, you (“you”, “User”, “Client”, or “Crew Member”) agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. Eligibility
To use the Service, you must:
- Be at least 18 years old,
- Have the legal capacity to enter into these Terms, and
- Use the Service in compliance with all applicable federal, state, and local laws in the United States.
2. Your Account
To access CrewCard, you must create an account or be provided one by your employer or contracting company.
You agree to:
Provide accurate and complete information,
Keep your login credentials confidential,
Not share your account with others,
Notify CrewCard immediately of any unauthorized access.
CrewCard is not responsible for any loss resulting from unauthorized account use caused by your actions or inaction.
3. Use of the Service
You may use the Service to:
View, accept, or decline shifts,
Manage availability,
Communicate with your employer/partner organization,
Upload required certifications and work documents,
Submit timesheets or job-related information.
You must not:
Misuse, reverse-engineer, or attempt to breach the platform,
Upload harmful, fraudulent, or illegal content,
Use the Service in a way that disrupts operations or violates law,
Impersonate another user or company.
CrewCard may suspend or terminate your access for violations of these Terms.
4. Payment and Billing (for Clients)
To gain access to the CrewCard App and its features, Clients must maintain an active, paid subscription with CrewCard USA LLC. Access to the app is not available without a valid subscription.
By creating an account, subscribing, or using CrewCard services, you agree to the following:
4.1 Subscription Requirement
A monthly or annual subscription is required to activate and maintain access to the Service.
Add-on modules (SMS packs, communications, onboarding tools, compliance modules, etc.) may incur additional fees.
If your subscription expires, lapses, or is canceled, all user access (including your staff) will be suspended until payment is restored.
4.2 Automatic Billing
You authorize CrewCard USA LLC to automatically charge your saved payment method for:
Subscription fees,
Add-on usage or module fees,
Any applicable taxes.
Charges are processed in U.S. Dollars (USD).
Subscription fees are billed in advance for the applicable billing period.
4.3 Changes to Pricing
CrewCard may update pricing or introduce new fees.
You will be notified in advance before any rate changes become effective.
Continued use after notification constitutes acceptance of the updated pricing.
4.4 Failed Payments
If a payment fails or is declined:
CrewCard may attempt to reprocess the payment,
Notify you of the issue,
And suspend or restrict access to the platform until payment is resolved.
CrewCard is not responsible for loss of functionality, scheduling issues, or operational impact caused by suspended access due to non-payment.
4.5 No Refunds
All subscription and add-on charges are non-refundable, unless required by U.S. law.
This includes (but is not limited to):
Prorated periods,
Early subscription cancellation,
Unused services or features,
Staff access not utilized.
5. User-Generated Content
You may upload content such as:
Certifications, licenses, and compliance documents,
Profile photos,
Timesheets and job data,
Notes or communications.
You retain ownership of your content but grant CrewCard a non-exclusive, worldwide, royalty-free license to store, process, and use the content solely to provide the Service.
We may remove content that violates these Terms.
6. Workplace, Safety & Compliance Data
CrewCard may be used to store and manage crew safety records, timesheets, certifications, and job documentation.
CrewCard is not responsible for:
Verifying accuracy of workplace compliance documents,
Determining legal eligibility to work,
Ensuring OSHA or state safety compliance,
Employer HR, payroll, or legal obligations.
Those responsibilities remain solely with the employer or contracting organization.
7. Privacy
Your use of the Service is also governed by the CrewCard USA Privacy Policy, which explains how we collect and process personal data under applicable U.S. privacy laws and, where relevant, GDPR.
8. Third-Party Services
CrewCard may integrate with external services such as mapping tools, messaging providers, payroll platforms, or cloud storage.
CrewCard is not responsible for:
The availability of third-party systems,
Their privacy practices,
Data loss or issues caused by third-party failure.
Your use of third-party services is subject to their terms.
9. App Store Terms (iOS & Android)
If you downloaded the CrewCard app from the Apple App Store or Google Play Store, their terms also apply.
Apple and Google:
Are not responsible for providing support,
Are not liable for claims relating to the app,
Are third-party beneficiaries of these Terms.
10. Service Availability
CrewCard aims for high uptime and reliability but does not guarantee:
Uninterrupted access,
Error-free operation,
Timely delivery of notifications, messages, or job alerts.
Maintenance, outages, or technical issues may occur.
11. Changes to the Service or Terms
CrewCard may update the Service or modify these Terms at any time.
Material changes will be communicated through the app or email.
Continued use after changes means you accept the updated Terms.
12. Intellectual Property
CrewCard owns all rights to:
Software, code, design, and features,
Branding, trademarks, and logos,
All platform content not uploaded by Users.
You may not copy, distribute, or modify any part of the Service without permission.
13. Termination
CrewCard may suspend or permanently terminate access if:
You violate these Terms,
Your employer’s subscription ends,
You misuse or attempt to damage the platform.
You may stop using the Service at any time.
Termination does not affect rights and obligations that by nature survive termination.
14. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind.
CrewCard does not guarantee:
Accuracy of job data or schedules,
That shifts will always be available,
That notifications will be delivered,
Compliance with employer legal obligations.
Use of the Service is at your own risk.
15. Limitation of Liability
To the fullest extent permitted by U.S. law:
CrewCard USA LLC, its employees, and partners are not liable for:
Loss of income, productivity, or employment,
Damages from missed shifts or miscommunication,
Data loss or unauthorized access,
Indirect, incidental, or consequential damages.
Our maximum liability to you for any claim is $100 USD.
16. Indemnification
You agree to indemnify and hold harmless CrewCard USA LLC from claims arising out of:
Your misuse of the Service,
Violation of these Terms,
Inaccurate or unlawful content you upload,
Workplace incidents or disputes unrelated to CrewCard’s technology.
17. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules.
Any dispute must be resolved in the state or federal courts located in Austin, Texas.
