CrewCard App Terms of Use
Terms that govern access to and use of the CrewCard mobile app.

These Terms of Use (“Terms”) govern your access to and use of the CrewCard mobile application, CrewCard web platform accessed through the app and related services (collectively, the “App Services”).
The App Services are operated by CrewCard USA, LLC (“CrewCard”, “we”, “us” or “our”).
By downloading, accessing or using the App Services, you agree to be bound by these Terms. If your access is provided through an employer, client or contracting organisation, your use may also be subject to that organisation’s agreement with CrewCard.
If you do not accept these Terms, you must not use the App Services.
1. Definitions
- “App” means the CrewCard mobile application and its related mobile features.
- “Account” means your CrewCard user account.
- “Data” means information, files, records, timesheets, work documents, certifications, messages or other content uploaded, entered or stored through the App Services.
- “Client Organisation” means the employer, client or contracting organisation that provides or manages your access to CrewCard.
- “Crew Member” means a user who accesses CrewCard for shifts, work opportunities or job-related activities.
2. Eligibility and Your Account
To use the App Services, you must:
- be at least 18 years old;
- have the legal capacity to enter into these Terms;
- use the App Services in compliance with applicable federal, state, and local laws in the United States; and
- have a valid CrewCard Account created by you or provided by your Client Organisation.
To access CrewCard, you must create an account or be provided one by your employer or contracting company. You agree to provide accurate and complete information.
You are responsible for keeping your login details confidential. You must not share your Account or allow another person to use it.
You must provide accurate and complete information and promptly notify CrewCard or your Client Organisation of any suspected unauthorised access to your Account.
CrewCard is not responsible for any loss resulting from unauthorized account use caused by your actions or inaction.
3. App Licence and Permitted Use
Subject to these Terms, CrewCard grants you a limited, revocable, non-exclusive and non-transferable licence to use the App Services for authorised workforce, scheduling and job-related purposes.
Depending on your access level, you may use the App Services to:
- view, accept or decline shifts;
- manage availability;
- access job information;
- communicate with your Client Organisation;
- upload certifications, licences or work documents;
- check in and check out of shifts;
- submit timesheets or job-related information; and
- access other CrewCard features made available to you.
4. Prohibited Conduct
You must not:
- misuse, interfere with or attempt to breach the App Services;
- reverse engineer, decompile, copy, modify or create derivative works from the App;
- upload harmful, fraudulent, misleading or unlawful content;
- use the App Services in a way that disrupts operations or violates applicable law;
- impersonate another person, crew member or organisation;
- harvest, scrape or collect data from the App Services without permission; or
- infringe the intellectual property, privacy or other rights of another person.
CrewCard may suspend or terminate access where these Terms are breached.
5. Mobile Permissions and Notifications
The App may request permission to access certain device features when required for a feature you choose to use. These may include:
- location services for GPS check-in, check-out or location-based job features;
- camera, photos or files for uploading documents, qualifications or profile images; and
- push notifications for shift offers, job updates, reminders or messages.
You can manage these permissions through your device settings. Disabling a permission may limit access to certain App features.
6. Data, Workplace Records and Compliance
You may upload or submit Data through the App Services, including certifications, licences, profile photos, timesheets, job information, workplace documentation, notes and communications.
You retain ownership of your Data. However, you grant CrewCard a worldwide, royalty-free, non-exclusive licence to host, store, process, back up and use that Data as reasonably required to provide, maintain and improve the App Services.
CrewCard may be used to store workforce, safety and compliance information. However, CrewCard does not verify:
- the accuracy or completeness of workplace documents;
- a person’s legal eligibility to work;
- compliance with OSHA, state safety requirements or other workplace obligations; or
- employer HR, payroll or legal obligations.
These responsibilities remain with the Client Organisation or relevant employer.
7. Payment, Fees and Subscription
Where a Client Organisation pays for CrewCard, applicable fees, billing periods, add-ons, taxes, payment terms and refund eligibility will be set out in the relevant subscription agreement, order form or Pricing Policy.
Failure to pay applicable fees may result in suspension or termination of access to the App Services.
8. Privacy
Your use of the App Services is also subject to the CrewCard USA Privacy Policy, which explains how personal information is collected, used, stored and disclosed.
9. Third-Party Services and App Stores
The App Services may connect with third-party services, including mapping tools, messaging providers, payroll platforms, cloud storage or other integrations.
CrewCard is not responsible for the availability, privacy practices, security or performance of third-party services. Your use of those services is subject to their own terms.
Where you download the App through the Apple App Store or Google Play, their applicable store terms may also apply to you.
10. Service Availability and Changes
CrewCard aims to provide reliable App Services but does not guarantee uninterrupted, error-free or secure access at all times.
The App Services may be unavailable due to maintenance, updates, internet outages, device issues or other events outside CrewCard’s reasonable control.
CrewCard may update, modify or discontinue App features from time to time. Material changes to these Terms may be communicated through the App, website or email.
11. Intellectual Property
CrewCard and its licensors own all intellectual property rights in the App Services, including the software, code, design, features, branding, trademarks and platform content.
Except for the limited licence granted under these Terms, no ownership rights are transferred to you.
12. Termination
CrewCard may suspend or terminate your access to the App Services where:
- you breach these Terms;
- your Client Organisation’s subscription ends or is suspended;
- you misuse or attempt to damage the App Services; or
- CrewCard reasonably needs to protect the security, integrity or lawful operation of the App Services.
You may stop using the App Services at any time.
When access ends, your right to use the App Services ends. CrewCard may not be required to retain or return Data after termination, subject to any separate agreement with the Client Organisation or legal requirement.
13. Disclaimer of Warranties and Limitation of Liability
To the maximum extent permitted by law, the App Services are provided “as is” and “as available”.
CrewCard does not guarantee:
- the accuracy of schedules, job information or timesheet data;
- that shifts or work opportunities will always be available;
- that notifications, messages or job alerts will always be delivered;
- uninterrupted or error-free operation; or
- compliance with employer, payroll, workplace or legal obligations.
CrewCard is not liable for indirect, incidental, special, punitive or consequential loss, including lost income, missed shifts, lost data, business interruption or loss of opportunity.
CrewCard’s total liability for any claim relating to these Terms is limited to the amount paid to CrewCard in the preceding 12 months, or US$100 where no fees were paid, whichever is greater.
14. Indemnification
You agree to indemnify and hold harmless CrewCard, its officers, directors, employees, agents and contractors against claims, losses, damages, costs and expenses arising from:
- your misuse of the App Services;
- your breach of these Terms;
- Data you upload or submit;
- your violation of applicable law; or
- workplace incidents or disputes unrelated to CrewCard’s technology.
15. Governing Law and Contact
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules.
Any dispute relating to these Terms must be brought in the state or federal courts located in Travis County, Texas.
